A choice "not to be a dick" will come from a person's ability feel empathy for others. With psychopaths and sociopaths, they don't tend to feel empathy, so will be unlikely to make the choice to not be a dick. Yet they did not choose to be born with the defective brain that is unable to feel empathy.
